Terms and Conditions Required Prior To Purchase

Throughout these Terms and Conditions, the term “Cotton Boll Pollinators LLC” refers to
1. Itself as a Limited Liability Corporation, 2. It’s managers, employees, staff, or any
person representing Cotton Boll Pollinators LLC. The term “customer” refers to any
patron of Cotton Boll Pollinators LLC, including those that purchase directly from Cotton
Boll Pollinators LLC (online or electronic purchases, in-person purchases, or purchases
through invoice and or shipment), those that purchase Cotton Boll Pollinators LLC
products at another/separate retailer/person/entity, or those that acquire Cotton Boll
Pollinators LLC products from the aforementioned entities, or acquire Cotton Boll
Pollinators LLC products in the form of gifts from another retailer/person/entity or
through subsequent sale/purchase from another person or entity.
Throughout these Terms and Conditions, the term “Bayed Bear Honey LLC” refers to 1.
Itself as a Limited Liability Corporation, 2. It’s managers, employees, staff, or any
person representing Bayed Bear Honey LLC. The term “customer” refers to any patron
of Bayed Bear Honey LLC, including those that purchase directly from Bayed Bear
Honey LLC (online or electronic purchases, in-person purchases, or purchases through
invoice and or shipment), those that purchase Bayed Bear Honey LLC products at
another/separate retailer/person/entity, or those that acquire Bayed Bear Honey LLC
products from the aforementioned entities, or acquire Bayed Bear Honey LLC products
in the form of gifts from another retailer/person/entity or through subsequent
sale/purchase from another person or entity.

All sales are final and products are sold as is. Honey is a raw, natural product, and
should be handled and stowed as such. Honey can and will crystallize over time, and
the rate of crystallization is influenced by surrounding conditions, type of honey, type of
sugar, sugar concentration, and the nectar gathered by bees to create honey, etc.
Additionally, honey may ferment over time, and spoil, and crystallization can influence
the rate of fermentation. Honey can also cause botulism in infants, therefore should not
be fed to children under 1 year of age. Therefore, the customer agrees and
acknowledges these facts about honey, and understand that honey should be
consumed within a timely manner following purchase, as it is not advised to be
consumed over a prolonged period of time, stored in high moisture or humid conditions,
nor should be fed to anyone with sensitivities or allergies to honey, botulism,
fermentation, etc. If crystallization is observed, honey can be heated by placing the
bottle or jar in warm water for several minutes until crystals dissolve. Special care
should be given to ensure that water, in liquid or gaseous form, DOES NOT contact
honey inside the container. This practice can cease or slow the crystallization process
for a period of time, however fermentation could have already occurred, therefore no
warranties are made regarding the likelihood, current status of fermentation, nor the rate
of fermentation after purchase. The customer agrees to assume all liability associated
with the consumption of honey, by the customer themselves, or anyone who
subsequently consumes honey provided by the customer. All honey produced by
Bayed Bear LLC is certified by the NC State Beekeepers Association, and is produced
according to the practices as established by the NC State Beekeepers Association
which can be found at https://www.ncbeekeepers.org/programs/certified-honey-
producer/certified-honey-producer-program-guidelines. Other food products, such as
jellies, are produced according to FDA and NCDA&CS guidelines
(https://www.ncagr.gov/fooddrug/food/homebiz.htm). Both honey and jellies have
relatively high sugar content and moisture content. These characteristics can attract
insects (flies, mites, ants, bees or other stinging insects, wasps, bugs, beetles, etc.),
pathogens (fungi, bacteria, viruses, amoebas, etc.), animals, etc. Therefore, the
customer agrees and acknowledges these facts about honey and jellies, and
understand that honey and jellies should be consumed within a timely manner following
purchase, as it is not advised to be consumed over a prolonged period of time, stored in
high moisture or humid conditions, nor should be fed to anyone with sensitivities or
allergies to such.

Our honey and jellies are bottled/canned according to stringent sanitation practices. For
products sold in sealed bottles or jars, the customer agrees to inspect the container
before opening, when opening, and before consumption of the product(s) and agrees to
notify and return any purchased products to Bayed Bear Honey LLC, before the product
is consumed. Some products are bottled in glass containers, which can crack or break.
The customer agrees to inspect all containers of purchased products, and notify and
return any products with broken seals, cracked or broken glass. As such, all products
are inspected by Bayed Bear Honey LLC before packaging for shipment. Additionally,
all products are packaged in a manner that reduces the likelihood of breakage. The
customer agrees to assume all liability broken seals, lids, cracked or broken containers
(plastic or glass), beyond the point of sale. As containers, seals, or lids, can be cracked
or broken during shipment, the customer understands and agrees that Bayed Bear
Honey does not assume any liability for breakage of any kind during shipment. All
claims regarding handling during shipment should be addressed by the customer
directly with company that conducts the shipment of products to the customer.
The customer also understands and agrees that even when properly sealed, honey or
jellies or other food products may spoil over time, therefore the customer agrees that
Bayed Bear Honey assumes NO liability related to crystallization, fermentation or
spoilage of any product beyond the point of purchase, which also applied to products
that remain sealed after purchase and before containers are opened or products are
consumed. Additionally, the customer acknowledges and agrees that it is the
customers’ responsibility to seek medical advise from medical professionals prior to
purchase or consumption of honey or jellies to determine the likelihood of allergic
reaction, and the customer agrees to assume all liability for consumption of honey or
jellies, whether such consumption is advised by medical professionals or not. Bayed
Bear Honey LLC makes no warranties or guarantees, expressed or implied, regarding
any health benefits of honey or other products. These Terms and Conditions can be
updated at any time, without notice, and is applicable to all purchases, regardless of
type.

Upon completion of reading these Terms and Conditions, the customer hereby
acknowledges and agrees that Bayed Bear Honey LLC is NOT liable, nor assumes any
future liability for warranties, handling, or consumption, or anything otherwise not noted
in these Terms and Conditions etc. regarding the purchase or consumption of any
products, in any manner, whether noted in this agreement or otherwise not noted,
beyond the point of sale. The customer must agree to these terms and conditions
before completion of purchase, including cash, check, mail-in check, credit card, etc. or
other purchases not made on and through the Bayed Bear Honey LLC website where
these Terms and Conditions are listed: www/bayedbearhoney.com. These Terms and
Conditions are provided on www.bayedbearhoney.com, however it is the responsibility
of the customer to request a copy of these Terms and Conditions in paper form, if one is
desired by the customer, and must be done so prior to completion of purchase.
